Closing Process

+ New Hampshire Buyer

All individuals named on the Lender's Commitment letter must be present at the closing unless alternative arrangements are made in advance. To ensure a smooth purchase, we have prepared this information to familiarize you with the closing process in the state of New Hampshire.

Closing Funds: The day before the closing is scheduled, please contact our office to determine how much money will be needed for closing. These funds must be in the form of a bank check or certified check and should be made payable to the client (yourself). At the closing, the check should be endorsed and made payable to our client trust account.

Insurance: Maintaining homeowner's insurance is required by the lender during the term of your loan commencing from the date of the closing. Coverage must equal or exceed the loan amount or a guaranteed replacement cost endorsement must be shown on the binder. Once a policy has been set up, please contact our office with the name and phone number of the respective insurance agent. We cannot close without this information.

If purchasing a condominium, there are different homeowner's insurance requirements. There is no need to obtain a separate homeowner's insurance policy for the building structure because the condominium association carries an insurance policy. However, we do need the name of the condominium association for the property. Please call our office with this information at your earliest convenience.

Picture Identification: It is our obligation to confirm the identity of the parties attending the closing. Each borrower must bring picture identification to the closing. Proper identification includes a driver's license, passport or employee ID card.

Owner's Title Insurance Policy: We strongly recommend that our clients obtain an Owner's Title Insurance Policy. We will prepare the policy prior to closing unless otherwise notified.

Scheduling: When the loan is approved and all conditions are satisfied, we will contact the client to schedule the closing. The day before closing is scheduled, however, the client should contact our office to determine how much money, if any, will need to brought to the closing. Current Mortgage Payoff Information: We cannot close without the mortgage payoff. The client should provide our office with this information. We will need the name of the bank, the loan number, and social security number of the client. Homestead: In New Hampshire, the legislator has enacted Homestead rights that protect a homeowner's principal residence from the forced sale by a creditor for a principal residence. These rights are also vested in the spouse of an owner if the property is a principal residence, regardless of whether the spouse is an owner of the property. Therefore, a non-borrowing spouse will need to be present at the closing to waive their Homestead rights for this transaction.

Other Services: Our office routinely handles other legal matters, such as trusts and wills. If you or someone you know needs legal assistance, please feel free to contact us for a free consultation. Additionally, please note that this office will conduct a title search at the Registry of Deeds to ensure that there are no unknown liens, mortgages, or encumbrances on the subject property. If the results of the title search indicate that there are problems, we will notify you. At that point, your attorney will need to clear that defect from the chain of title. If you do not have your own attorney, please let us know and we will perform this service for an additional fee. However, it should be understood that we do not represent you for this transaction.

Homestead: In Massachusetts, legislation creating a right of Homestead was enacted in order to protect a homeowner's principal residence from the forced sale by a creditor. If you would like my office to prepare a Declaration of Homestead for your property, please call my office prior to closing. The charge for the Homestead is $75.00 plus state recording fees.

+ Massachusetts Seller

Deed: Please call our office to let us know if you have your own attorney or if we will prepare the new deed. If our office is preparing the deed, the fee is $100.00.

Smoke Detector Certificate: Please obtain this document from your local fire department.

Final Water Bill: Our office will need either a paid receipt or, in advance of the closing, the amount of the final water bill which will be deducted from the sale proceeds.

Forwarding Address: We will need the forwarding address to contact you if there are any post closing issues.

Certificate of Occupancy and Certificate of Compliance: For new construction only, please obtain these certificates from the local town hall.

6(d) Certificate: If your property is a condominium, please obtain a 6(d) Certificate from the respective condominium association stating that all condominium fees are paid and current. Additionally, please note that this office will conduct a title search at the Registry of Deeds to ensure that there are no unknown liens, mortgages, or encumbrances on the subject property. If the results of the title search indicate that there are problems, we will notify you. At that point, your attorney will need to clear that defect from the chain of title.
